Protect Your Right to Vote – Stop the SAVE Act!


What is the SAVE Act?

The national Safeguard American Voter Eligibility (SAVE) Act is a bill that passed the U.S. House of Representatives on April 10, 2025 and is now before the Senate. If passed, it would make many changes to the National Voter Registration Act of 1993, including requiring every American voter to be able to show documentation to prove their U.S. citizenship to:

  • Register to vote
  • Change their registration
  • Defend their right to vote if their citizenship is challenged

The SAVE Act says:

SAVE ACT: Section 2. (b) (3)

“Under any method of voter registration in a State, the State shall not accept and process an application to register to vote in an election for Federal office unless the applicant presents documentary proof of United States citizenship with the application.”

 

The SAVE Act has a specific list of acceptable documents and requires that they must be presented in-person to an “appropriate election official.”

 

Forget registering to vote online, or pre-registering at school as at 16. You must show up in person to present your proof of citizenship documents to an ‘appropriate person’.  The only way to get registered to vote when you get your Driver’s license would be to bring all your citizenship paperwork along, too.

 

It’s a great voter suppression tactic to reduce the number of people who register to vote.


Why do we Need the SAVE Act?

 

   We don’t

 

The requirements of the SAVE Act are wholly unnecessary, because it’s already against the law to vote in federal elections if you’re not a citizen.

  • In 1924 the last state in the union at that time finally made it illegal for noncitizens to vote in federal elections. Alaska and Hawaii followed suit.
  • In 1996 the US Congress made it “unlawful for any person to make a false claim to United States citizenship in order to vote or register to vote” by passing the “Illegal Immigration Reform and Immigrant Responsibility Act of 1996.”

 

Non-citizen voter fraud is exceedingly rare.

The costs to implement the SAVE Act are unjustified for citizens, the government, and our democracy.

It’s No Problem,  I’m Already Registered . . .

 

Sounds like this only applies to new voting registrants, so - not my problem?  WRONG!

 

If you’re already registered, the SAVE Act still applies to you. Under the SAVE Act anyone who’s already registered can be picked off the Voter List at any time for a citizenship check. 

 

Under the SAVE Act, any Federal department or agency can demand, on just 24 hours’ notice, that the local Registrar of Voters produce your voter registration information, including what documentation you ever provided to prove you’re a certified U.S. Citizen. And no, having a ‘Real ID’ Driver’s license does NOT count as proof of citizenship under the SAVE Act.

 

The SAVE Act says:

SAVE ACT: Section 2. (b) (3)

(A) IN GENERAL.—At the request of a State election official (including a request related to a process established by a State under paragraph (2)(A) or (2)(B)), any head of a Federal department or agency possessing information relevant to determining the eligibility of an individual to vote in elections for Federal office shall, not later than 24 hours after receipt of such request, provide the official with such information as may be necessary to enable the official to verify that an applicant for voter registration in elections for Federal office held in the State or a registrant on the official list of eligible voters in elections for Federal office held in the State is a citizen of the United States, which shall include providing the official with such batched information as may be requested by the official.

 

 

Do you have all your citizenship paperwork in order and close to hand? You won’t have much time to respond before you might be told you can’t vote.

My Passport Works as citizenship proof, Right?

 

Yes, mostly - As long as it’s current, then it’s proof of citizenship. If yours is close to expiration, you might want to renew it soon – demand is high, and there are fewer people to help you.

 

No - not if it’s expired.  Right now, it may take you quite a while to renew a passport that’s expired, especially if it expired over 15 years ago.

My Real-ID is Citizenship Proof, Right?

 

  Wrong. The only thing your Real-ID works for is getting onto an airplane to fly within the borders of the United States. (You can also use a US Passport for that.)

 

Just five states issue a special Real-ID with an embedded chip that allows crossing the border with Canada. California is not one of those states.


Well, I just need a copy of my Birth Certificate, right?

 

Just a ‘copy’ of your Birth Certificate is never enough.  

 

First, you’ll also need a current “government-issued photo ID” – like a driver’s license or state ID card to go along with your birth certificate. College student ID’s from state schools used to work, but in many places that’s not true anymore.

 

Second, a birth certificate ‘copy’ may not be the right kind of “certified” certificate copy under the SAVE Act. Under the SAVE Act your Birth Certificate needs to meet every one of the following seven criteria:

 

The SAVE Act says:

SAVE ACT: Section 2. (a)

A certified birth certificate issued by a State, a unit of local government in a State, or a Tribal government which—

‘‘(i) was issued by the State, unit of local government, or Tribal government in which the applicant was born;

‘‘(ii) was filed with the office responsible for keeping vital records in the State;

‘‘(iii) includes the full name, date of birth, and place of birth of the applicant;

‘‘(iv) lists the full names of one or both of the parents of the applicant;

‘‘(v) has the signature of an individual who is authorized to sign birth certificates on behalf of the State, unit of local government, or Tribal government in which the applicant was born;

‘‘(vi) includes the date that the certificate was filed with the office responsible for keeping vital records in the State; and

‘‘(vii) has the seal of the State, unit of local government, or Tribal government that issued the birth certificate.

 

Many people have problems with the ‘seal’ in item (vii) – most states require that you pay extra for a Birth Certificate copy that is certified or sealed - having the seal embossed or attached. And some people born in rural areas, especially prior to mid-twentieth century, may not ever have had government-filed birth paperwork.

 

Also, you will need MORE than just your ID and Birth Certificate IF:

 

1. If you have changed your name (or had your name changed for you), you need to prove the ‘chain’ of your name changes through:

   Event

Additional Paperwork needed

  Getting married

Marriage license(s)

  Getting divorced

Divorce decree(s)

  Being adopted – incl. via parents’ divorce

Adoption decree(s) (see note 4 below)

Divorce decree(s), Marriage license(s)

  Changing your name for any other reason

Legal Name Change decree

 

2. If you are a Naturalized Citizen – you'll need a Naturalization Certificate or Certificate of Citizenship

 

3.  If you were born outside the USA to US parents – you'll need a CRBA-Consular Report of Birth Abroad  
                  (or see https://www.usa.gov/citizenship-to-us-parent for more details)

4.  If you’re adopted – check the date on your adoption certificate. An existing Federal law requires that your birth certificate, when presented for ID, must be dated no later than 1 year after your birth date, and also the SAVE Act requires that it must be issued by the ‘state’ in which you were born. This can be a problem for adoptees, as revised birth certificates are often filed with adoption papers, with new filing dates and place of filing. You may need a copy of your adoption decree to justify the ‘late’ filing date and/or the wrong ‘state’ on your birth certificate.
5. If you changed your name as a kid when your divorced parent remarried, but never went through formal adoption - find a lawyer. You need to establish documentation for why your current name is not the same as your birth certificate.

What’s happening with the SAVE Act Now?

  • The SAVE Act passed the US House on April 10, 2025.  
  • It’s now working its way through the Senate (“I’m just a Bill…🎶”).
  • There’s a much better chance to stop the SAVE Act in the Senate because the bill needs 60 votes to pass, and as of June 2025 there are:
    • Republicans: 53
    • Democrats: 45
    • Independents: 2 (both caucus with the Democrats)

May 20, 2025

WASHINGTON, D.C. Today, U.S. Senator Alex Padilla (D-Calif.), Ranking Member of the Senate Committee on Rules and Administration and California’s former Secretary of State, blocked Senator Mike Lee’s (R-Utah) attempts to unanimously pass theSafeguard American Voter Eligibility (SAVE) Act, which would lead to the disenfranchisement of millions of eligible American citizens if passed. Padilla blasted the overly burdensome documentation requirements in the SAVE Act, which would make registration harder for new voters, married women, rural voters, servicemembers, communities of color, and the tens of millions of Americans who register to vote online or by mail.


Lee’s harmful proposal came in response to Senator Padilla’s attempt to pass the Including New Voters In The Electorate (INVITE) Act by unanimous consent to improve voter registration services at naturalization ceremonies. In responding to Lee’s objection, Padilla emphasized that Congress should try to make voting easier for eligible American citizens, not harder. He also debunked misinformation about widespread voter fraud, highlighting that voter fraud is extremely rare.


A review of the 2016 general election found that only 0.0001 percent of votes came from improper noncitizen voting among the jurisdictions reviewed.

  • “It is a solution in search of a problem. Audit after audit, review after review, investigation after investigation, has demonstrated that the instances of ineligible immigrants voting in elections is exceedingly, exceedingly, exceedingly rare, which again, means our current laws are working.”
  • “To suggest that birth certificates be required for a certain task when it’s already secure — I don’t make it a habit of walking around with my birth certificate in my pocket. A passport’s another acceptable form of documentation for citizenship. Half the American public doesn’t have a current valid passport because not everybody travels abroad on a regular basis. So they’re unnecessary. Our current laws are working, and therefore I object.”


Padilla has led the charge opposing President Trump and Republicans’ reckless attempts to restrict the right to vote. Last week, he convened a Rules Committee Democrats spotlight hearing focused on Congressional Republicans’ SAVE Act and Trump’s illegal anti-voter executive order,  both of which threaten to disenfranchise millions of eligible American citizens. As President Trump marked 100 disastrous days in office, Padilla led his Democratic colleagues on the Senate floor to speak out against theS AVE Act and the Trump Administration’s attacks on election integrity. Last month, Padilla warned Secretaries of State, Lieutenant Governors, and Chief Election Officials across the country of the devastating potential impacts of the SAVE Act, concerns that have been echoed by top election officials across the country. Padilla also recently led a letter sounding the alarm on the devastating impacts of the SAVE Act and Trump’s illegal anti-voter executive order on Native American voting rights.

That doesn’t mean they don’t need to hear from you. Every fighter needs encouragement.

  • Repeat OFTEN!

  • If you have a current US Passport, congratulations. Make sure it’s in a safe and accessible place.

  • If you don’t have a Passport, figure out exactly what you’ll need to prove your citizenship, and start bringing it together. It may take a lot longer (and cost a lot more) than you think.

  • Help friends and family organize their citizenship paperwork
